About PinOaks Park
PinOaks Park is an independent Thoroughbred Transition Centre based in Canterbury, New Zealand.
Our services include, but are not limited to:
- Transition Assessments
- Racing Retirement Services
- Rehoming Support
- Managed Listings
- Marketplace Services
- Welfare Assessments
- Rehabilitation Planning
- Education and Resources
Bookings
Bookings are confirmed only once:
- an application has been received (where applicable);
- payment has been received (unless otherwise agreed in writing); and
- an appointment has been confirmed by PinOaks Park.
PinOaks Park reserves the right to decline or cancel any booking where we believe we cannot safely or appropriately provide the requested service.
Pricing & Estimates
All prices are quoted in New Zealand Dollars (NZD).
Unless otherwise stated, all advertised prices are exclusive of GST.
Any quotation or estimate provided by PinOaks Park is an estimate only and is not a fixed quotation unless expressly stated. Actual costs may vary depending on the horse’s condition, additional services required, travel, veterinary recommendations, or unforeseen circumstances.
PinOaks Park reserves the right to amend pricing at any time. Updated pricing will apply to future bookings only.
Payment Terms
Transition Assessments
Payment is required in full before a Transition Assessment appointment is confirmed, unless otherwise agreed in writing.
Managed Listings & Marketplace Listings
Payment is required before a listing is published.
Rehabilitation & Ongoing Care
Where horses are receiving rehabilitation, agistment or ongoing services through PinOaks Park, invoices are payable within 7 days of the invoice date unless otherwise agreed in writing.
Overdue Accounts
If payment is not received by the due date, PinOaks Park may, at its discretion:
- charge interest on overdue accounts at 2% per calendar month, calculated daily and compounded monthly until paid in full;
- recover any reasonable debt collection costs, legal costs or expenses incurred in recovering the outstanding debt; and
- suspend or refuse further services until the outstanding balance has been paid.
Transition Assessments
Transition Assessments are professional assessments based on:
- veterinary findings;
- behavioural observations;
- information supplied by the owner or trainer; and
- the horse’s presentation at the time of assessment.
Recommendations are provided to assist decision-making and represent our professional opinion based on the information available on the day of assessment.
A Transition Assessment is not a guarantee of:
- future soundness;
- future behaviour;
- future temperament;
- future performance;
- suitability for any discipline; or
- future saleability.
Horses are living animals and their condition, behaviour and performance may change over time.
Veterinary Services
Where veterinary examinations form part of a Transition Assessment, veterinary findings remain the professional opinion of the attending veterinarian.
PinOaks Park does not diagnose or treat medical conditions unless those services are provided by a registered veterinarian.
Client Decisions
The client acknowledges that any decision made following a Transition Assessment, including whether to rehabilitate, sell, retain, retire or euthanase a horse, remains entirely the responsibility of the owner.
PinOaks Park provides independent recommendations to assist decision-making but does not make decisions on behalf of the owner.
Welfare First
Horse welfare is the foundation of every service provided by PinOaks Park.
Where welfare concerns are identified, recommendations will always prioritise the horse’s wellbeing, even where those recommendations differ from the owner’s expectations.
Owner Responsibilities
Owners and authorised representatives agree to:
- provide accurate and honest information;
- disclose any known injuries, illnesses or veterinary history;
- disclose known behavioural issues or dangerous behaviours;
- advise of any infectious disease risks;
- ensure horses are safe to handle during assessments.
The owner warrants that all information supplied is true and accurate to the best of their knowledge.
Failure to disclose relevant information may affect the assessment outcome and the safe delivery of services.
Right to Refuse Services
PinOaks Park reserves the right to refuse, postpone or discontinue any service where:
- the horse presents an unacceptable safety risk;
- significant welfare concerns exist;
- false or misleading information has been provided;
- invoices remain unpaid; or
- continuing the service would be unsafe, unethical or impractical.
Managed Listings
Where PinOaks Park provides a Managed Listing service:
- ownership remains with the owner unless otherwise agreed in writing;
- PinOaks Park acts as the owner’s marketing representative only;
- enquiries and buyer communication may be managed by PinOaks Park;
- the owner remains responsible for accepting or declining offers unless ownership has transferred to PinOaks Park.
Managed Listings do not guarantee the successful sale of a horse.
Marketplace
PinOaks Park provides an online marketplace connecting buyers and sellers.
Unless otherwise stated:
- all sales occur directly between buyer and seller;
- PinOaks Park is not a party to the sale agreement;
- PinOaks Park does not guarantee the accuracy of information provided by sellers;
- buyers are responsible for undertaking their own inspections, veterinary examinations and due diligence before purchasing.
PinOaks Park reserves the right to edit, refuse, suspend or remove any listing that does not meet our standards or values.
Limitation of Liability
To the maximum extent permitted by New Zealand law, PinOaks Park is not liable for any indirect, consequential or incidental loss arising from:
- reliance on Transition Assessment reports;
- changes in a horse’s condition after assessment;
- decisions made by owners, trainers or purchasers;
- the sale or purchase of horses through the Marketplace; or
- circumstances outside our reasonable control.
Nothing in these Terms & Conditions excludes any rights that cannot legally be excluded under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
Intellectual Property
All reports, photographs, graphics, branding, educational resources, website content and documentation produced by PinOaks Park remain the intellectual property of PinOaks Park unless otherwise stated.
No material may be copied, reproduced or distributed without prior written permission.
Privacy
Personal information is collected, stored and used in accordance with the PinOaks Park Privacy Policy.
Website Availability
While we aim to keep our website available at all times, we cannot guarantee uninterrupted access and accept no responsibility for temporary outages, maintenance or technical issues beyond our reasonable control.
Dispute Resolution
If any dispute arises relating to these Terms & Conditions or the services provided by PinOaks Park, both parties agree to first attempt to resolve the matter through open communication and good faith discussions.
Where a resolution cannot be reached, the parties agree to consider mediation before commencing legal proceedings.
Nothing in this clause prevents either party from exercising any legal rights available under New Zealand law.
Changes to These Terms
PinOaks Park reserves the right to amend these Terms & Conditions at any time.
The most current version will always be published on our website and will apply from the date of publication.
Governing Law
These Terms & Conditions are governed by the laws of New Zealand.
Any disputes shall be subject to the exclusive jurisdiction of the New Zealand Courts.
